CRC appeals for a constructive dialogue between BTV MEDIA GROUP EAD and BULSATCOM AD in the name of the Bulgarian consumer

 

On its session the Communications Regulation Commission (CRC) has considered the letters received from BTV MEDIA GROUP EAD and BULSATCOM AD concerning the raised between the two companies dispute regarding the broadcasting in the electronic communications network of BULSAT of BTV television programs.

 

After analysis of the exposed by the two undertakings problems and circumstances it is clear that the dispute between them has a commercial character and should be solved in the conditions of voluntariness and mutual understanding. The Commission’s competences are explicitly and comprehensively regulated in the Law on Electronic Communications (LEC), in the issued on its grounds acts and in the applicable acts of the EU Law. In this connection, the CRC as a regulatory authority in the field of carrying out electronic communications has no powers to intervene in the contractual relations between the undertakings. In case that no agreement will be reached between the parties, the Bulgarian Court has the competence for solving this dispute. The other state authority which has the powers for intervention and control in cases of limitation of the competition on the market for provision of radio and TV services is the Commission for Protection of Competition (CPC). The CRC would be able to render only mediatorial support with a view to overcoming and solving the raised problems.

 

Given the deepening of the difficulties and the provoked public dissatisfaction, the Communications Regulation Commission appeals for establishment of a constructive and beneficial dialogue between the two parties, which will lead to solution of the problem with the purpose to protect the interests of market and especially of the Bulgarian consumers.
