The CRC provides the market analyses for unbundled and broadband access for second/repeated consultation after extending the scope of the document

 

 

The Communications regulation Commission (CRC) has decided to extend the scope of the market analysis for unbundled and broadband access by including in it regulation of the duct network, towers, masts, technological premises and all equipments of BTC known as passive infrastructure of the incumbent.

 

Due to significant changes of the initial variant, the draft of the market analysis has been submitted for second consultation with the interested parties and published in the website of the CRC in section “Public consultation”.

 

The Bulgarian Regulator designated BTC as an undertaking having significant market power and foresees to impose on it (specific) obligation to provide access to the relevant equipment at non-discrimination and transparent conditions.

 

Other remedy foresees the access to be accomplished at cost-oriented prices which will be based on approved by the CRC cost accounting system.

 

Till the approval of a cost accounting system, BTC is obliged to observe the prices according to the acting at the moment common conditions.

 

The CRC Decision for extending the scope of the analysis is a result of a carried out public consultation in which significant part of the alternative undertakings insisted the document to include the passive infrastructure of BTC as well.

 

After carried out additional analysis of the market, the Regulator determined that the offered by the operators suggestions are well-grounded and they have been reflected in the market analysis.

 

The expectations are that the changes will guarantee publicity and non-discrimination when using the duct network and the equipment of BTC by which the effective competition on the relevant market will be improved and the interests of the end-users will be protected.
