A letter from BNR has been registered with ref. No. 12-01-278/04.10.2019 at the Communications Regulation Commission (CRC) on 04.10.2019 г. at 13:23 hours.

CRC was notified with the letter that the BNR Management Board took a decision and objected to carrying out maintenance through ceasing emission from transmitters located at CRTC Vitosha (Kopitoto). The correspondence between BNR and “NURTS Bulgaria” EAD (NURTS) was enclosed to the letter. NURTS reminded BNR with a letter sent through electronic mail on 03.10.2019 that an annual technical maintenance of transmitters emitting BNR programs has been planned for 04.10.2019. NURTS requested also the BNR explicit written consent for carrying out the maintenance by 03.10.2019 COB . It is indicated that the maintenance planned on 04.10.2019 for the timeframe between 09:00 and 17:00 hours at CRTC Vitosha is according to the enclosed NURTS Order No. 8242180533/14.11.2018 for annual technical maintenance for 2019 BNR FM technology and in execution of the contract concluded between BNR and NURTS for broadcasting of radio programs.

BNR notified NURTS with letter ref. No.20-585/03.10.2019 that it explicitly objects to carrying out the maintenance on 04.10.2019 and suggests to conduct it after 10.11.2019.

The planned maintenance is in execution of an agreed timetable, established pursuant to Art. 5.1.4 and Art. 5.2 of the contract between NURTS and BNR for broadcasting of radio programs. Carrying out technical maintenance of the transmitter is in accordance also with item 2 of Attachment No. 5 to Art. 10 of the Technical requirements for operation of electronic communications networks from the broadcasting radio service and the related equipment, adopted by CRC and is conducted at least once per year.

In conjunction with the daily monitoring of the radiofrequency spectrum and subsequent analysis carried out by CRC no interruption of the emission of BNR transmitter stations from CRTC Vitosha in the city of Sofia has been established on 04.10.2019.

In view of the stated facts and the conducted monitoring the actions of the two undertakings do not contradict to the legislation controlled by the regulator. They are related to their obligations according to the contract for broadcasting of radio programs.
