Notification of public electronic communications networks and services

Public electronic communications shall be provided by sole entrepreneurs and legal persons upon submission of a notification to the Communications Regulation Commission (CRC). The notification application form can be found here (available in Bulgarian language).

The notification also may be submitted on a template prepared by the Body of European Regulators in the Field of Electronic Communications (BEREC).

Exemption from the obligation to submit a notification:

Notification is not required, where:

  1. number-independent interpersonal communications services are provided;
  2. access to a public electronic communications network is provided via a local radio network by enterprises, public sector organizations, non-governmental organizations or end-users, for whom the provision of such access is not part of an economic activity or is in addition to an economic activity or public service, which is not dependent on the transmission of signals over these networks.

Attachments:

For persons, not registered in Bulgaria: a document for the current registration under the national legislation.

For those who do not have a registration/account in CRC online questionnaire system: an application form for creating a profile in the system (available in Bulgarian language).

Register of providers of public electronic communications networks and services:

CRC enters the person in the register of providers of public electronic communications networks and services and sends the received notification to BEREC within 14 days from the date of receipt of the notification or from elimination of the incompleteness.

Requirement to submit periodic reports:

The providers of public electronic communications network and service in Bulgaria should submit through the online questionnaire system an annual report on its activity during the past year. The annual report is submitted through the system by March 15 each year. The obligation arises from the General requirements for public electronic communications (available in Bulgarian language). Additionally, providers of internet access service, should submit report as of July 1 through the system by August 15 each year.

Fees:

The providers of public electronic communications networks and services in Bulgaria collect an administrative annual fee for controls to ensure regulatory activities. The amount of the fee is determined in the Tariff of fees collected by the Communications Regulation Commission (available in Bulgarian language) and is 0.2% of gross revenues from all activities in the provision of electronic communications without VAT when these revenues exceed 100 000 BGN (if these revenues do not exceed 100 000 BGN, the amount of this fee is 0%).
