Grounds:

 

The Communications Regulation Commission (CRC) by Decision № 2050 dated September 18, 2008 adopted Draft  FUNCTIONAL SPECIFICATIONS for portability of non-geographic numbers in the event of change of the provider of the relevant service.

 

In accordance with Art.134, para1, item 2 of the Law on Electronic Communications (LEC) the undertakings providing public telephone services should provide their customers with the possibility to retain their non-geographic number in the event of change of the provider of the relevant service.

 

Following § 6 (1) of the Transitional and Final Provisions of the LEC this obligation is into force and should be implemented as of January 1, 2009. 

 

As per Art.134, para 3 of the LEC the non-geographic numbers portability has to be implemented in accordance with rules, defined in functional specifications, adopted by the CRC.

 

I connection with the above competencies, with the present draft the CRC defines the technical rules, the procedure and the payment principles for the portability implementation, which considers that have to be defined by the regulator.

 

The CRC considers that the adoption of the current draft will contribute to the creation of conditions for development of competition in providing services through non-geographic numbers.

 

In accordance with Art.134, para 3, in relation with Art.36 of the LEC, the CRC launches a procedure of public consultation.
